Rabel Terms of Service

Welcome to Rabel!

These Terms of Service are a binding contract between you and Rabel, LLC (“we”, “us”, “our”). They govern your use of Rabel’s platform, services, and content. Please read them carefully.
By accessing or using our platform, you agree to these Terms, our Privacy Policy, and any other guidelines referenced herein.

1. Acceptance of Terms

By accessing or using Rabel, you accept and agree to be bound by these Terms. If you do not agree, you may not use our platform.
Rabel reserves the right to modify these Terms at any time. Users will be notified of significant changes, and continued use of Rabel after changes constitute acceptance.

2. Eligibility

To use Rabel, you must be at least 18 years old.
By creating an account, you affirm that you meet this age requirement and that all information provided is accurate.

3. Account Registration and Security

Registration: You must create an account to access certain features. Registration is free and requires accurate and up-to-date information.
ID Verification: To maintain a secure and trustworthy platform, all Creators on Rabel must complete an ID verification process before publishing their content. This step ensures that Rabel remains a safe environment for both Creators and Viewers, upholding authenticity and accountability.
Account Security: You are responsible for the security of your account credentials. Rabel is not liable for any losses caused by unauthorized access due to user negligence.
Account Activity: All activities conducted through your account are your responsibility. Notify Rabel immediately if you believe your account has been compromised.

4. Profiles on Rabel: Creators and Viewers

Creators: Creators upload and monetise their original content on Rabel. Creators are solely responsible for the content they share and must comply with Rabel’s content guidelines. Creators can
- Monetize Content: Creators can upload original videos and set purchase prices, earning revenue through Rabel’s 90/10 revenue share model. Rabel receives 10% at Point of Sale and pays upfront the Stripe processing fee. The Creators 90% commission is held in escrow for 72 hours to honor Rabel’s 72 hour refund policy. After 72 hours, the commission is automatically released to the Creators Stripe account minus the Stripe processing fees that are reimbursed to Rabel.
- Retain Ownership: You maintain full ownership of your content while granting Rabel a license to display, distribute, and adapt it for various devices.
- Creative Control: Rabel supports free speech and a creator’s freedom of expression. Your content must comply with U.S. laws and Rabel’s Content Policy Guidelines.
Viewers: Viewers can access and purchase content from Creators on the platform. Viewers are expected to comply with all platform policies and respect intellectual property rights. Viewers can -
- Purchase and Enjoy Content: Browse and purchase content from Creators to watch on demand. Each purchase supports the Creators directly.
- Engage Respectfully: Provide constructive feedback, comments, or ratings, contributing to a positive community for Creators and other Viewers.
- Report Violations: If you encounter content that seems to violate Rabel’s guidelines (such as illegal or inappropriate material), you can report it for review. Things Viewers Cannot Do (including but not limited to):
  - Harass or Threaten Others
  - Share or Reproduce Content Illegally
  - Spam or Misuse the Platform
  - Circumvent Purchase Requirements
  - Manipulate Platform Metrics
Purchasing Access: Creators may also act as Viewers to purchase or access other content on the platform. All purchase terms apply equally to Creators when they are acting in the capacity of Viewers.

5. User Content and Responsibility

Ownership and License: You own what you create. Any original content you post on Rabel remains yours and is protected by copyright and applicable laws.
Your content should not violate someone else’s rights. Do not copy, reproduce, modify, publish, distribute, or otherwise use any content you don't own unless you have a written permission from the owner.
To display your content on Rabel, and to allow viewers to enjoy them, you grant us certain rights in your content.
- Platform License for Content: By posting content on Rabel, you grant us a license to translate, modify, reproduce, and adapt your content as necessary to operate and improve our platform. This includes making adjustments to ensure your content is accessible on various devices and networks, such as formatting for compatibility on smartphones and computers.
- Public Content License: You also grant Rabel the above license, along with the rights to display, perform, and distribute it. Additionally, you give all Rabel users permission to access, view, and interact with your content, as permitted by the platform’s features.
- License Duration: These licenses are royalty-free, perpetual, irrevocable, and worldwide. This is a usage license only and does not affect your ownership of the content.
By uploading, Creators grant Rabel a non-exclusive, worldwide, royalty-free, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content on our platform.
Content Guidelines: Rabel supports freedom of speech but has a zero-tolerance policy for illegal content, including but not limited to:
- Child pornography: Any visual depiction of a minor engaging in sexually explicit conduct. This includes photos, videos, and live streams. Rabel is committed to reporting illegal child exploitation to relevant authorities.
- Pornographic Material: Explicit pornography is not allowed. Nudity may be acceptable if it’s within the context of the content and does not constitute pornography. Incitement to violence: Videos that directly promote or encourage violence, such as terrorist acts or mass shootings.
- Defamation: Videos that falsely accuse someone of wrongdoing and damage their reputation.
- Copyright infringement: Videos that use copyrighted material without permission, such as music, movies, or TV shows. Threatening or harassing content: Videos that threaten or harass individuals or groups.
- Deepfakes: Manipulated videos that make it appear as if someone is doing or saying something they didn't.
- Unlawful Content: Any other material that is illegal under federal and state laws.
Responsibility for Content: Creators are solely responsible for the content they post. Rabel is not liable for content posted by Creators but reserves the right to remove or restrict access to content that violates these Terms or U.S. laws.

6. Content Moderation and Reporting

Platform Oversight: Rabel maintains the right to moderate content to ensure compliance with platform guidelines and legal requirements.
Reporting Mechanism: Users can report content they believe violates these Terms. Rabel will review reports and take appropriate action, which may include the removal of the content or suspension of the account.
Review and Appeals: If content is removed, Creators may request an explanation or appeal the decision within a reasonable timeframe.

7. Intellectual Property Rights

Creator Content: Creators retain ownership of their content but grant Rabel the rights necessary to display and distribute it within the platform.
Platform Content: Rabel’s branding, logos, software, and other proprietary content are the property of Rabel LLC and protected by intellectual property laws. These Terms don’t grant you any right, title or interest in Rabel, or our trademarks, logos, and other intellectual property. Unauthorized use is prohibited.
You hereby acknowledge and agree that you are not an employee, agent, partner, or joint venture of Rabel LLC, and you do not have any authority of any kind to bind us in any respect whatsoever.

8. Fees, Payments, and Refunds

Purchasing Access: Viewers can purchase access to content on Rabel. Fees for these purchases are detailed at the time of the transaction.
Payment Processing: Payments on Rabel are processed by third-party providers. Rabel is not responsible for payment errors, delays, or security issues related to third-party services.
Refunds: Refunds requested within 72 hours of purchase are subject to Rabel's Refund policy. After 72 hours, refund requests are subject to the Creator's discretion.

9. Community Guidelines and Prohibited Activities

Respectful Conduct: Viewers and Creators must treat each other with respect and refrain from posting harmful or disruptive content.
Prohibited Activities (including but not limited to): Activities that violate Rabel's Terms of Service (TOS) Attempting to bypass security features. Uploading harmful software, including viruses or malware. Engaging in harassment, threats, or abuse toward other users or Rabel staff. Impersonating other users or creating multiple accounts to manipulate engagement or avoid enforcement actions.
Consequences: Violations may result in suspension or termination of accounts without notice. In severe cases, legal action may be taken.

10. Privacy and Data Use

Data Collection: Rabel may collect personal data to provide, improve, and personalize the user experience. See our Privacy Policy for details.
Data Sharing: Rabel may share data with third-party partners for payment processing, analytics, and service improvement. Data will not be shared for unauthorized purposes.
User Rights: Users have the right to access, update, or delete their personal data within the bounds of our Privacy Policy.

11. Disclaimer

The content provided on Rabel is for informational and entertainment purposes only and represents the opinions of the creators. It does not necessarily reflect the views or opinions of Rabel. The content should not be considered professional advice. Viewers are advised not to take any action based solely on the content without consulting a qualified expert, such as a licensed physician, lawyer, financial advisor, or other relevant professional. Rabel does not endorse or verify the accuracy of any advice or recommendations shared by creators on the platform.

12. Limitation of Liability

To the greatest extent permitted by law, Rabel, its licensors, or its suppliers are not liable for indirect, special, incidental, punitive, or consequential damages arising from the use of our platform. To the greatest extent permitted by law, our liability for damages is limited to the amount of money we have earned through your use of Rabel. We are specifically not liable for loss associated with unfulfilled offerings and benefits and from losses caused by conflicting contractual agreements. For this clause, “we” and “our” is defined to include our subsidiaries, affiliates, officers, directors, employees, agents, and third-party service providers.
Rabel is provided on an "as-is" basis, without any express or implied warranties. This includes implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted use.
Rabel makes no representations or warranties about the accuracy, legality, or decency of content accessed through the platform, nor does it guarantee any products or services offered by Creators. All products, services, and publications on Rabel are provided “as-is” without warranty.

13. Violations of the Terms

Failure to follow any of these Terms constitutes a breach, which may result in immediate termination of your account. Rabel reserves the sole right to determine whether a violation of these Terms has occurred.

14. Termination and Account Suspension

Termination by User: Users may delete their accounts at any time.
Suspension or Termination by Rabel: Rabel may suspend or terminate accounts that violate these Terms or pose risks to the community. Actions may include temporary suspension, removal of content, or permanent account termination.
Data Retention: Rabel may retain certain data after account deletion as required by law.

15. Dispute Resolution and Governing Law

These Terms are governed by and will be construed in accordance with applicable federal laws and the laws of the State of Wyoming, USA, excluding its conflict of law provisions.
We encourage you to reach out to us directly if any dispute arises from these Terms or your use of Rabel. In the event of a dispute, both parties agree to attempt to resolve the issue through good-faith mediation in Wyoming before proceeding to litigation.
If mediation does not resolve the dispute, it will be resolved in the federal or state courts located in Wyoming. Both parties consent to the exclusive jurisdiction and venue of Wyoming courts. Wyoming law, excluding its conflict of law provisions, governs these Terms and all Rabel policies.
The prevailing party in any action or proceeding arising out of these Terms will be entitled to an award of costs and attorneys’ fees.

16. Changes to Terms

Rabel may update these Terms as our services evolve. If changes are made, we’ll notify you via the website, email, or other means. If you disagree, you may stop using Rabel. Continued use after changes take effect means you accept the new Terms. Amendments are only valid if in writing and signed by both you and Rabel.

Your continued use of Rabel signifies your acceptance of these Terms in their entirety. If you do not agree, you must discontinue use of the platform.
